NRI Investment FAQ

Can NRIs invest in mutual funds in India?
Yes. NRIs can invest in Indian mutual funds through NRE (Non-Resident External) or NRO (Non-Resident Ordinary) accounts. NRE account investments are fully repatriable. NRO account investments are repatriable up to USD 1 million per financial year after applicable taxes. NRIs from the USA and Canada face additional FATCA compliance requirements, but many major fund houses (HDFC, ICICI, Nippon, SBI) do accept US/Canada NRI investments with proper documentation.
What is RNOR status and how long does it last?
RNOR (Resident but Not Ordinarily Resident) is a special tax status under the Indian Income Tax Act that applies to returning NRIs for 2–3 years after they return to India. During this window, foreign income — income earned or accrued outside India — remains completely tax-free in India. This allows returning NRIs to liquidate foreign investments, repatriate funds, and restructure their portfolio without Indian tax liability on foreign earnings. The window typically lasts 2 years from year of return, sometimes extending to 3 years.
Do NRIs pay double tax on Indian investments?
No — India has signed Double Taxation Avoidance Agreements (DTAA) with over 90 countries including USA, UK, UAE, Singapore, Australia, and Canada. You don't pay tax twice on the same income. For example, dividends from Indian stocks may be taxed at a treaty-reduced rate in India, and you can claim credit for those Indian taxes against your host-country tax liability. Proper DTAA structuring requires expert coordination.
NRE vs NRO account — which is better for mutual fund investments?
NRE account: holds foreign earnings converted to INR. Principal and interest are fully repatriable; interest is tax-free in India. Use for investments funded from your foreign salary — gains can go back abroad freely. NRO account: holds India-sourced income (rent, dividends, pension). Repatriation capped at USD 1 million/year after TDS. Use for reinvesting income earned within India. For SIPs: if you're sending money from abroad, use NRE (full repatriation). If you're investing India rental income, use NRO.
Can NRIs in the USA invest in Indian mutual funds?
Yes, but with additional compliance requirements. US-based NRIs must provide FATCA (Foreign Account Tax Compliance Act) declarations, and some AMCs do not accept US/Canada NRI investments due to compliance complexity. However, major fund houses — HDFC Mutual Fund, ICICI Prudential, Nippon India, SBI Mutual Fund — do accept US NRI investments with proper FATCA compliance. Mintra FinServ helps US-based NRIs navigate FATCA requirements and fund selection.
